  • Terms and conditions

    The following are the Terms and conditions (the “Agreement”) which govern your access and use of our online platform through which mental health and psychotherapy may be provided (collectively the “platform”). The website is owned and operated by Livewell Psychotherapy Ltd, 6 Westcroft Square, W60TB UK. admin@livewellpsychotherapyonline.com. The platform maybe provided or be accessible to multiple websites or applications, whether owned and /or operated by us or third parties, including but without limitation the website Transpersonalcollective.com or Camillalivewell and its related sites or apps.

    By accessing or using this platform you are entering into this Agreement. You should read this Agreement carefully before using the platform. If you do not agree to be bound by any terms of this agreement, you must not access the platform.

    When the terms “we”, “us, “our” or similar are used in this Agreement, they refer to any company that owns or operates the Platform (the “Company”).

    ‍

    The Therapy and Therapist Services offered.

    ‍ ‍This Platform may be used to connect you to a registered, qualified Psychotherapist based on the available UK UKCP code of conduct regulations who will provide services to you online, exclusively through the Platform for online work.

    ‍

    We require all our therapists to have UKCP accreditation and/or 4 plus years of training under supervision. We commit to inspecting graduation certificates, UKCP accreditation membership, DBS reports, and individual supervision reports before a therapist can join the platform.

    ‍

    As a long-term psychotherapy platform (as opposed to counselling or low-cost service) we do not offer telephone or messaging services for therapy. We require you to commit to 6 initial online sessions after the assessment, as this is the period of time it takes to evaluate the therapeutic fit.

    ‍

    Sessions will be at a set hour on the same day, with the same chosen therapist, repeating weekly and rarely bi-weekly, if needed.

    ‍

    There will be no contact between you and the therapist apart from scheduling, between online sessions to create a clear boundaried approach in accordance with the UKCP code of conduct. In the case of an emergency, it is advised to call emergency services and help lines readily available on the website.

    Non-circumvention - once an introduction has been made to a suitable therapist and contact has been made via the platform, you agree that all future online sessions with the chosen Transpersonal Collective-registered therapist will take place via the Transpersonal Collective platform and no attempt to work with the therapist directly (online only) will be made by you.

    The therapists are independent providers who are not employed by Livewell Psychotherapy LTD in any capacity. Livewell Psychotherapy LTD’s (operating under the brand name Transpersonal Collective) role is limited to connecting registered therapists with Clients and Platform users, providing the technical and administrative support to do so. The Company does not itself provide Therapy Services and it is not a healthcare entity. Therapists work entirely independently of the platform and they are fully responsible for their insurance and performance in the capacity of therapists.

    If the chosen therapist is not deemed to be a good therapeutic fit, you may change your therapist on the Platform at anytime after the initial 7 sessions. If your chosen therapist stops using the platform after you have been connected, we will send an email to notify you and present another opportunity to contact another skilled therapist.

    Whilst we hope that Therapist Services are beneficial to you, you understand, agree and acknowledge that they might not be appropriate for every particular situation and/or a substitute for certain mental health needs that might require in-person, psychiatric or hospital care of any kind. Examples of this include but not limited to: anorexia, schizophrenia, suicidal ideation and substance abuse withdrawal.

    This site is not intended for the provision of clinical diagnosis requiring in-person evaluation. It is also not intended for any information regarding which medication or medical treatment may be appropriate for you and any advice if delivered through the Platform, it should be disregarded. Do not use this Platform if you need any official documentation for use in court or any other legal purposes such as, but not limited to, court-ordered therapy

    In an Emergency:

    ‍ ‍

    If you are considering suicide or harming yourself in any way or you consider that another person might be in danger or if you are experiencing a medical emergency, you must contact emergency services in your local area immediately. The therapists on this platform are not able to provide the level of assistance required in the aforementioned cases therefore by using this platform you do so entirely at your own risk.

    Privacy and Security

    ‍

    Confidentiality, protecting and safeguarding the information shared by you on the platform, is our top priority. We adhere to GDPR laws. We do not share any personal data or information you share with your therapist with third-party advertisers. We do use partner with service providers to assist in marketing campaigns and they can only legally use data at our direction. You are able to request data erasure at anytime by sending us an email admin@livewellonlinetherapy.com.

    You agree to not to video/voice record by any means, any session with your therapist without his / her consent in writing.

    Disclaimer of warranty and limitation of liability

    ‍

    To the maximum extent permitted by law, you hereby release us and agree to hold us harmless from any and all clauses of action and claims of any nature resulting from the therapist services or the platform including, without limitation, any act, omission, opinion, response, advice, suggestion, information and/or service of any therapist and/or any content or information accessible through the platform. You understand, agree and acknowledge that the platform is provided as is and without any express or implied warranties of any kind, including but not limited to, merchantability, non-infringement, security, fitness for a particular purpose or accuracy. The use of this platform is at your own risk. To the fullest extent of the law, we expressly disclaim all warranties of all kinds either expressed or implied.

    You understand, agree and acknowledge that our aggregate liability for damages arising with respect to this agreement and any and all use of the platform will not exceed the total amount of money paid by you or on your behalf through the platform in the 12 months before the date of the claim.

    Cancellation policy

    ‍

    If you are unable to attend an appointment, please cancel at least 48 hours before the appointment to ensure therapists receive enough time to plan efficiently and offer others help if necessary.

    ‍

    Cancellations and rescheduling impact the therapist's earnings. Where possible, a mutually convenient alternative appointment will be offered.

    ‍

    In the event of need for cancellation of a session out of the 48-hour cancellation window payment will be kept in credit for use at the next scheduled session.

    ‍ ‍

    Inside the 48-hour cancellation period, you agree that the cancelled or missed session will be paid in full.

    ‍

    You reserve the right to cancel your subscription to the service at anytime.

    ‍

    We reserve the right to adjust the price of the service and we will do our best to inform you beforehand should this occur.

    ‍

    There is a 14-day withdrawal period after the contract is formed. Please write to admin@livewellonlinetherapy with your full name, contact details and reasons for withdrawal.

    Payment

    The assessment is billed at half the cost of a normal session and will be billed in advance of the session.

    ‍ ‍

    Payment for each session will be taken by Livewell Psychotherapy LTD at the normal rate online by debit or credit card, in advance, automatically, before each session at the booking stage. You will be sent a payment link and on payment, the session will be confirmed and booked. Non-payment prior to the session means the session is not scheduled.

    ‍

    In the event of cancellation of a session, out of the 48-hour cancellation window, payment will be kept in credit for use at the next scheduled session.

    ‍

    Inside the 48-hour cancellation period, you agree that the cancelled or missed session will be paid in full.

    ‍

    Intellectual Property

    ‍ ‍

    The platform, website Transpersonal Collective.com, belongs to Livewell Psychotherapy LTD and all rights, title and interest, including all related intellectual property rights therein, are owned by the Company. This agreement does not convey or grant you any rights in or related to the platform, or any intellectual rights owned by Livewell Psychotherapy Ltd.

    Subject to your compliance with these terms, Livewell Psychotherapy Ltd grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable licence to: Access and use the platform solely in connection with the use of services on your personal device, and access and use any content, information and related materials that might be available through the services. In each case for your sole, non-commercial use. Any rights not expressly granted herein are reserved by the company.

    Consent to receive electronic Communication

    You agree that Transpersonal Collective and or therapists may contact you regarding therapist services or any related services that you inquire about via our portal, website or related app. You consent to receiving information electronically.

    Governing Laws and Jurisdiction

    ‍

    This agreement, and any dispute or claim (including non-contractual disputes or claims) arising or in connection with Livewell Psychotherapy LTD, Transpersonal Collective.com and all related companies, apps and websites, shall be governed by and construed in accordance with the laws of England. Each party irrevocably agrees that the courts of England shall have exclusive jurisdiction to settle and dispute or claim (including non – contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
